Welcome
to the Bidango end user agreement. The following describes the
terms by which Bidango offers you free access to our services.
By
using our services, you agree to the following terms and conditions.
Throughout this User Agreement, you will see underlined links
to other related documents. We recommend that, as you read
this User Agreement, you also access and read the information
contained in the other pages referred to in this document,
as they may contain further terms and conditions that apply
to you as a Bidango user.
We
may amend this User Agreement at any time by posting the amended
terms at Bidango.com. All amended terms shall automatically
become effective 30 days after they are initially posted on
Bidango.com. In addition, we will notify you in accordance
with your Notification Preferences. This User Agreement may
not be otherwise amended except in a writing signed by you
and Bidango, Inc. This User Agreement is effective on Jan
17th, 2004 for all users.
Bidango
is a site where shoppers can come to do comparison shopping
on thousands of items. We gather data from hundreds of stores
and arrange it in a format which can be easily searched by
the consumer. As such, we have no control over the pricing
or availability and cannot be held responsible for any availability
or price discrepancies between the information displayed on
our site and the actual information from the retailer. Of
course we strive for accuracy, and in most cases this is achieved
by our frequent updating process. However, there is always
a possibility that a retailer has recently updated their prices
or inventory, and that our information is out of date. In
these cases, or the case of a discrepancy for any other reason,
you agree that Bidango is not held liable.
Also,
although the store ratings on Bidango play as important of
a role as product reviews, you recognize that neither type
of review is offered or backed by Bidango. All reviews, whether
store or product, come from end users, and Bidango takes no
responsibility for retailer accountability nor any product
guarantees. Should you decide to purchase a product from a
retailer linked through our site, you understand that you
are entering into an agreement with the retailer alone and
that Bidango has no part in the transaction. Any returns,
disputes, or need for customer service in regard to your purchase
will be solely between you and the retailer.
Therefore,
in the event that you have a dispute with one or more retailers,
you release Bidango (and our officers, agents, and employees)
from claims, demands and damages (actual and consequential)
of every kind and nature, known and unknown, suspected and
unsuspected, disclosed and undisclosed, arising out of or
in any way connected with such disputes.
